The personal injury case against JetBlue, according to a federal judge, is best decided by a jury

Last week, a federal judge in Massachusetts denied JetBlue’s motion for summary judgement. The judge found that it was best for a jury to decide whether the airliner was negligent in its maintenance actions following multiple incidents of an overhead bin detaching from its compartment. One of these incidents allegedly resulted in a passenger being injured.

David Mellor brought a claim for personal injuries against JetBlue after he was injured in February 2018 when he was hit by an overhead bin door that became detached during a flight on a JetBlue A320-232 aircraft. U.S. District Judge Indira Talwani for the District of Massachusetts dismissed JetBlue’s move for summary judgement in the case. Mellor was injured when the door to the overhead bin became detached. During the ascent, another passenger rose up and unlatched the door to the overhead compartment after it had been closed and fastened for the whole of the trip. According to the order that was submitted on September 29th, the door became disconnected after it was unlatched, and it then collapsed on Mellor.
